A.  Data controller

I. Processing of protocol data

When you visit our website, we process the following log files from you, which do not allow any inference to your person:

  • An anonymous cookie ID which does not make it possible to infer your IP address,
  • The operating system you are using, the web browser you are using and the screen resolution settings which you are using,
  • The date and time of day of your visit,
  • The web sites which you have visited of us and
  • The web site from which you are visiting our web site.

The legal basis for processing this personal data is our legitimate interest of being able to provide the website properly (Article 6 paragraph 1 letter f GDPR). This personal data is only being processed as long as you access our website.

 

C.    Use of cookies and tracking tools

I.      General Information

Volkswagen AG uses various cookies on its websites. Cookies are small files containing configuration information that are stored on your end device. Cookies can basically be divided into three categories. There are cookies which are essential for the functionality of the website (so-called functional cookies), cookies which increase the level of comfort when visiting a website and, for example, save your language settings (so-called comfort cookies) and cookies which are used to create a pseudonymised user profile (so-called tracking cookies).

The processing of functional cookies is necessary to enable you to visit the website (Article 6 Paragraph 1 letter b GDPR).

Tracking cookies are only set if the website visitor has given his/her consent (Article 6 Paragraph 1 letter a GDPR). Consent is given via the so-called cookie banner, which must be actively clicked on.

II.    Adobe Analytics

This website uses the web analysis tool Adobe Analytics to evaluate user access to this website. Data processing is in so far is based on your consent (Article 6 paragraph 1 letter a GDPR).

For evaluation purposes, cookies are stored on your end device and information about them is collected, which is also stored on servers of our data processor Adobe Systems Software Ireland Limited ("Adobe"). Access to the information by Adobe Systems Incorporated, a U.S.-based company, cannot be excluded. EU standard contractual clauses have been agreed to, to offer adequate safeguards on data protection for the processing in non-European countries. A direct personal reference of the information stored on the Adobe servers is excluded, because Adobe Analytics is used with the settings "Before Geo-Lookup: Replace visitor's last IP octet with 0" and "Obfuscate IP-Removed". The setting "Before Geo-Lookup: Replace visitor's last IP octet with 0" ensures that the IP address is anonymized by replacing the last octet of the IP address with zeros before this so-called geolocalization. The approximate location of the user is added to the tracking packet for statistical evaluation, which still contains the full IP address. Before the tracking packet is saved, the IP address is replaced by a single fixed IP address - this is called a generic IP address - if the setting "Obfuscate IP -Removed" is configured. This means that the IP address is no longer contained in a stored data record.

D.   Your rights

You may assert the following rights vis-à-vis Volkswagen AG at any time free of charge. Additional information on exercising your rights can be found under Section F.

Right to information: You have the right to obtain information from us regarding the processing of your personal data (Article 15 GDPR).

Right of rectification: You have the right to request that we rectify any of your personal data that is incorrect or incomplete (Article 16 GDPR).

Right to erasure: You have the right, in the event that the requirements specified in Article 17 of the GDPR have been met, to demand the deletion of your data. Accordingly, you may request the deletion of your data, for instance, if it is no longer necessary for the purposes for which it was collected. Furthermore, you may request deletion if we process your data on the basis of your consent and you revoke this consent.

Right to restriction of processing: You have the right to request the restriction of the processing of your personal data if the requirements specified under Article 18 of the GDPR have been met. This is the case, for example, if you dispute the accuracy of your data. You may request that processing is restricted for as long as it takes to examine the correctness of your data.

Right to object: If the processing is based on a predominantly legitimate interest, you have the right to object to the processing of your data. An objection is permissible if the processing is either in the public interest or based on a legitimate interest of the Volkswagen AG or a third party. In the event of objection, we ask you to inform us of the reasons for which you object to data processing. In addition, you have the right to object to data processing for direct marketing purposes. This also applies to profiling in so far as it is related to direct marketing.

Right to data portability: If data processing is based on consent or contract fulfilment and is also based on the use of automated processing, you have the right to receive your data in a structured, standard and machine-readable format and to transmit it to another data processor.

Right of revocation: Insofar as the data processing is undertaken based upon consent, you have the right to revoke your consent for the data processing, with future effect at any time, free of charge.

Right to lodge a complaint: You also have the right to lodge a complaint with a supervisory authority (e.g.: with the State Data Protection Officer for Lower Saxony) regarding our processing of your data.
